NEW FONDITAL COMMERCIAL GUARANTEE
GUARANTEES LAW 2022
Following the publication on 28 April of Royal Decree-Law 7/2021 transposing Directive 2019/771 on Contracts for the Purchase and Sale of Goods, the law on guarantees has changed.
- The main changes included in the law are the following:
- Legal warranty period goes from 2 to 3 years;
- Test load period goes from 6 months to 2 years;
- Obligation of the existence of repair services and spare parts for 10 years from the last manufacture of the product
- 12-month repair warranty
- Entry into force remains in force as specified in the directive itself: January 1, 2022
Following these changes, Fondital has modified the commercial warranty for the following products
- Boilers (3 years total if the revision is made according to RITE stipulations)
- Gas heaters (2 years total, 3 years in pieces)
- Gas radiators – Gazelle Evo (3 years total if revised according to RITE stipulations)
- Aerothermal Heat pumps (2 years total, 3 years in parts)
- Electric transmitters (2 years total, 3 years in parts)
The Fondital commercial guarantee for radiators and towel rails is not modified.
FUNDITAL COMMERCIAL WARRANTY
Fondital S.p.A. offers its teams an additional and voluntary commercial guarantee that respects the framework of the legal guarantee and does not prejudice or annul the rights provided for in Royal Legislative Decree 7/2021, of 27 April.
The validation of the control certificate by a Technical Service called by Fondital S.p.A. for the next 60 days from the commissioning of the installation by the installer, it is essential to acquire the rights established in the commercial guarantee.
This commercial warranty is valid as long as the normal maintenance operations described in the technical instructions supplied with the equipment are performed.
· With respect to the legal guarantee, the commercial guarantee Fondital S.p.A. includes:
Free initial inspection by an Official Technical Service or by Fondital S.p.A. (Do not replace installer certificates) which includes the following:
a) Checking the correct operation of the boiler. This work does not in any case include intervention in the hydraulic, electrical or chimney installation.
· In order to carry out the initial inspection, the installation must have a gas supply, be filled with water and the boiler must be connected to the mains.
b) Commissioning and verification of the correct operation of the boiler and its safety mechanisms
c) Verbal explanation to the customer of the operating instructions for the boiler user.
Devices installed in accordance with current legislation and regulations and complying with the instruction manual and warnings provided by the manufacturer, are guaranteed against any manufacturing defects within the following period: 3 years.
In order to enjoy the three-year warranty, the user must carry out an inspection of the equipment by authorized personnel Fondital SpA, before the end of the second year of operation of the equipment with respect to commissioning, this inspection involves a charge that will not be covered by the Fondital commercial guarantee.
